General terms and conditions of contract

1. Premises and Definitions

This document governs the general conditions of sale of the goods offered on the website www.gisar.it (hereinafter, the “Site”), owned by:

For the purposes of these terms:

• Company : GiSar by Cucchiarini Sara and CSas

• Customer : any person who purchases goods through the Site.

• Consumer Customer : a natural person acting for purposes other than any entrepreneurial, commercial, artisanal or professional activity carried out, pursuant to Legislative Decree 206/2005 (“Consumer Code”).

• Professional/Business Client : natural or legal person acting in the exercise of their entrepreneurial or professional activity.

These conditions are drawn up in compliance with the Consumer Code (Legislative Decree 206/2005 and subsequent amendments), Legislative Decree 70/2003 (Electronic Commerce) and applicable European Union legislation.

2. Object of the Contract

The Company offers for sale clothing items for men and women, with the characteristics and prices indicated on the Site in the respective product sheets.
The purchase takes place according to the methods indicated in these General Conditions of Sale and in the online ordering procedure.

3. Conclusion of the Contract

The order placed by the Customer through the Site constitutes a purchase offer. The contract is finalized when the Company sends an order confirmation via email, which will contain a summary of the purchased product, price, shipping costs, payment method, and delivery address.

4. Prices

All prices are expressed in Euros and include VAT, unless otherwise indicated.
Shipping costs are calculated and indicated separately before confirming the order.
For customers with favorable tax regimes (e.g., intra-EU sales without VAT) who request delivery to Italy, VAT will still be applied.

5. Billing

• The order confirmation sent by email has no fiscal value.

• The Customer can request an invoice at the time of ordering by providing their tax code and/or VAT number, certified email (PEC) and/or SDI code.

• It is not possible to request an invoice after order confirmation, pursuant to art. 22 of Presidential Decree 633/1972.

• In the absence of a certified email address and/or SDI code, the invoice will be delivered to the customer's tax drawer via the Revenue Agency's Exchange System.

6. Payment Methods

The Company accepts the following payment methods:

• Credit/debit card (via secure “Stripe” platform)

• Cash on delivery (cash on delivery; minimum €40 – maximum €400; additional cost €5)

• PayPal

• Klarna (payment by installments; terms and conditions on the official Klarna website)

The Company never gains access to your complete payment details, which are managed directly by the secure platforms of the payment service providers.

7. Delivery

7.1 Timings

The Company delivers within 30 days of the contract being concluded, unless otherwise agreed in writing. Average delivery times are indicated in each product's description.
In case of multiple orders, shipment will take place in a single solution.

7.2 Delays

The Company is not responsible for any delays attributable to the carrier. In the event of a delay exceeding 30 days, the Customer may withdraw from the contract and receive a full refund.

7.3 Verification of the Goods

Upon delivery the Customer must check:

• integrity of the package;

• correspondence between received packages and transport document.

Any damage or anomalies must be reported to the carrier by adding the words “I accept with reservations” .
Reports to the Company must be made within 5 days of delivery.

8. Warranty

• Consumer Customers : 2-year legal guarantee of conformity (articles 128-135 of the Consumer Code).

• Professional Customers : 1-year warranty (art. 1490 et seq. of the Civil Code).
  The warranty covers manufacturing defects only; damage due to improper use or modifications is excluded.

9. Right of Withdrawal

The Consumer Customer has the right to withdraw within 14 days of receiving the goods, without having to provide a reason, except for legal exceptions (Article 59 of the Consumer Code).
Withdrawal must be communicated in writing via email or certified email.

10. Effects of Withdrawal

• The Company will refund the price within 14 days of notification of withdrawal, using the same payment method used for the purchase.

• The following are not refunded: shipping costs, cash on delivery costs (€5), and return costs from foreign countries.

• Returns from Italy: return costs paid by the Company.

• Returns from the EU/abroad: return costs to be paid by the customer.

11. Limitations on Withdrawal

The right of withdrawal lapses if the returned product:

• it is not complete with labels, tags or original packaging;

• shows signs of use, washing, damage or stains.

12. Shipping Costs

Shipping costs are indicated before order confirmation and are not refunded in the event of withdrawal, except where required by law.

13. Intellectual Property

All contents of the Site (texts, images, trademarks, logos, designs) are the property of the Company or authorized third parties.
Reproduction or use without written permission is prohibited.

14. Applicable Law and Jurisdiction

The contract is governed by Italian law.

• Consumer Customers : court of the place of residence or domicile of the Customer.

• Other Customers : exclusive jurisdiction of Pesaro.

16. Privacy

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 101/2018. For further details, please consult the Privacy Policy .

17. Customer Obligations

By placing an order on the Site, the Customer declares that he has read, understood and accepted these General Conditions of Sale.

18. Gift Voucher

1. Availability and Purchase
   Gift Vouchers can be purchased exclusively online on the website www.gisar.it and are available in various denominations at the Customer's choice.

2. Validity
   The Gift Card is valid for 24 months from the date the purchase confirmation email is sent. It can be used for one or more orders and for amounts exceeding the value of the card, paying the difference using an available payment method.

3. Delivery of the Code
   The Gift Card code will be sent to the email address provided during purchase. The Company is not responsible for any errors in the email address provided by the Customer.
   If payment is made immediately (e.g., credit card, PayPal), the Gift Card will be sent within 2 hours of order confirmation. If payment is not made immediately, it will be sent after confirmation of the credit.

4. Usage

• The Gift Voucher can only be used on the website www.gisar.it and by entering the code in the appropriate field at checkout.

• The code cannot be combined with other Gift Vouchers or other discount codes, unless otherwise specified on the Site.

• A Gift Card cannot be used to purchase another Gift Card.

• The Gift Card is not refundable or convertible into cash or credit, except for the right of withdrawal within 14 days of purchase if not yet used.

5. Returns of orders paid with a Gift Card
   If an order paid for in whole or in part with a Gift Card is returned, the amount paid for with the Gift Card will be credited back to the original Gift Card with the same expiration date as the original.

6. Security and Fraudulent Use
   The Company reserves the right to refuse orders placed using suspicious, duplicate, or fraudulently obtained Gift Cards.
